Jane May of IMFK has created a memo on the current status of the Paid Leave for All Workers Act (PLAWA). The Illinois Department of Labor (IDOL) issued its proposed regulations on PLAWA on Friday. According to the regulations, if an employer has a qualifying pre-existing leave policy that provides 40 hours of paid leave (or a pro rata equivalent) to all employees (part-time, full-time, seasonal), and employees can take leave for any reason, that will satisfy PLAWA’s requirements.
There are three policy options. Under the first option, an employer need only enact or revise its leave policy by 1/1/24 to meet the requirements set out above. Options 2 and 3 track all of the PLAWA requirements and award leave on an accrual or lump sum basis, respectively.
